1. Introduction

These Terms of Service govern access to and use of KhomoLanu.com, a digital property marketplace operated by KhomoLanuLink in Malawi. By accessing or using the platform, creating an account, posting a listing, browsing listings, or paying any platform fee, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the platform.

2. Nature of the Platform

KhomoLanu.com is a digital property marketplace that enables landlords, property owners, and authorized persons to upload property listings and enables tenants and buyers to search, view, and inquire about those properties.

KhomoLanu.com operates as a platform provider and marketplace facilitator. Unless expressly stated otherwise:

• We are not the owner of listed properties;
• We are not the receiver or holder of funds exchanged directly between users;
• We are not automatically a party to any rental, lease, sale, or purchase agreement between users;
• We do not guarantee that any listing will result in a successful transaction.

3. Eligibility

To use KhomoLanu.com, you must:

• Be at least 18 years old;
• Have legal capacity to enter into binding agreements;
• Provide accurate, current, and complete information;
• Use the platform only for lawful purposes.

4. Accounts

Users may be required to create an account to post listings, access certain features, or pay platform fees. Users are responsible for maintaining accurate account details, protecting login credentials, and all activity conducted through their account.

KhomoLanuLink may suspend, restrict, or terminate accounts that breach these Terms or create legal, security, reputational, or fraud risks.

5. Listings

5.1 Owner and Landlord Listings

Landlords and property owners may upload listings subject to platform review and approval.

5.2 Pre-Publication Review

All listings are reviewed before they are published to help reduce fraudulent, misleading, or scam-related activity. KhomoLanu.com reserves the right to reject, remove, edit, suspend, or decline any listing that appears false, incomplete, unauthorized, unlawful, suspicious, or inconsistent with platform standards.

5.3 Listing Warranties

By posting a listing, the user represents and warrants that:

• The property exists;
• The user owns the property or is authorized to market it;
• The information provided is true, accurate, and not misleading;
• The uploaded content does not infringe third-party rights;
• The listing complies with applicable law.

6. Agents

Agents may be allowed to post or manage listings only where they have valid permission from the property owner. KhomoLanu.com may require proof of authorization before approving such listings.

Where an agent acts without owner authorization, misrepresents authority, or charges users in a manner not permitted by KhomoLanu.com policy, the platform may remove the listing, suspend the account, or terminate access.

7. Fees

7.1 Annual Maintenance Fee — Landlords & Property Owners

Landlords and property owners shall pay a maintenance fee of MWK 2,000 per year for use of the platform listing service, unless otherwise stated in a specific package, promotion, or written communication.

7.2 Viewing Fee — Tenants & Buyers

Tenants and buyers shall pay a viewing fee of MWK 5,000 where required to access designated property viewing, contact, or platform-related services for 15 days.

7.3 Boosting Fees

• 3 days: MWK 3,000
• 7 days: MWK 7,000
• 14 days: MWK 14,000
• 30 days: MWK 30,000

7.4 Nature of Fees

All fees paid to KhomoLanu.com are platform service fees for digital listing, review, publishing, visibility, access, and related website services. These fees do not constitute rent, deposits, purchase money, or brokerage fees exchanged directly between users.

8. Refund Policy

KhomoLanu.com does not receive or hold money exchanged directly between tenants or buyers and landlords or sellers. The platform only receives its own service-related fees.

• Platform fees are non-refundable once the service has been activated, listing reviewed or published, viewing access granted, or boost period commenced;
• Refunds may only be considered for duplicate payment, clear technical billing error, or another exceptional case determined solely by KhomoLanu.com.

9. Verification

KhomoLanu.com offers identity and property verification as part of its fraud-reduction processes. However, verification does not amount to a legal guarantee, title warranty, or certainty that a transaction is free from dispute, loss, or fraud. Users remain responsible for carrying out their own due diligence.

10. Prohibited Conduct

Users must not:

• Post fake, deceptive, misleading, or duplicate listings;
• Impersonate another person or entity;
• Upload content without legal authority or use stolen photos or documents;
• Engage in fraud, scams, harassment, abuse, or intimidation;
• Interfere with the website's systems, security, or integrity;
• Upload malicious code, harmful files, bots, or scripts;
• Make unauthorized commercial use of the platform;
• Scrape, extract, copy, or harvest listing data without permission.

11. Communications and Transactions

KhomoLanu.com may facilitate contact between users, but users remain solely responsible for their communications, negotiations, inspections, agreements, payments, and decisions. The platform does not guarantee the honesty, conduct, solvency, suitability, or performance of any user.

12. Intellectual Property

All platform design, structure, branding, text, logos, layout, system elements, and software associated with KhomoLanu.com remain the property of KhomoLanuLink or its licensors.

Users retain ownership of content they upload, but by uploading content they grant KhomoLanu.com a non-exclusive, royalty-free, worldwide license to host, reproduce, display, publish, distribute, adapt, and use that content for purposes of platform operation, promotion, moderation, and service improvement.

13. Suspension and Termination

We may suspend, remove, restrict, or terminate accounts, listings, or services where there is:

• Breach of these Terms;
• Fraud or suspected fraud;
• Misleading or unauthorized listing activity;
• Non-payment of fees or abuse of users or platform systems;
• Legal or regulatory risk.

Where termination occurs because of breach, no refund shall ordinarily be due.

14. Disclaimer

KhomoLanu.com is provided on an "as is" and "as available" basis. We do not warrant that:

• The platform will always be uninterrupted, secure, or error-free;
• Every listing is accurate, lawful, current, or complete;
• Every property owner, landlord, tenant, buyer, or agent is genuine;
• A listing will result in a successful transaction.

15. Limitation of Liability

To the fullest extent permitted by law, KhomoLanu.com and KhomoLanuLink shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary losses arising from use of the platform.

Where liability cannot be excluded, total liability shall be limited to two times the amount paid by the relevant user for the specific service giving rise to the claim.

16. Indemnity

Users agree to indemnify and hold harmless KhomoLanu.com and KhomoLanuLink from claims, liabilities, losses, damages, costs, and expenses arising from:

• Breach of these Terms or unlawful conduct;
• False, misleading, or unauthorized listings;
• Infringement of third-party rights;
• Disputes arising from user content, transactions, or misuse of the platform.

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Malawi. Any dispute arising in connection with the platform or these Terms shall be subject to the jurisdiction of the competent courts of Malawi unless another lawful dispute resolution process is agreed in writing.

18. Changes to Terms

KhomoLanu.com may revise these Terms from time to time. Updated Terms will be posted on the website with a revised effective date. Continued use of the platform after such revision constitutes acceptance of the updated Terms.
